CJI Gawai told Kapil Sibal- come directly on the issue

The three -judge bench of the country’s Chief Justice (CJI) Justice BR Gavai was hearing a bench of three judges headed by Aligar Muslim University (AMU) today (on Monday) as Vice Chancellor of Aligarh Muslim University (AMU), hearing the appeal filed against the Allahabad High Court’s decision to retain the appointment of Professor Naima Khatoon. Apart from CJI Gawai, the back also included Vinod Chandran of Justice and Justice NV Anjaria. Meanwhile, Justice Chandran separated himself from this case.

During the hearing, Justice Chandran revealed that when Professor (Dr.) Faizan Mustafa was appointed Vice Chancellor of Chanakya National Law University (CNLU), he was the Chancellor there. Since Mustafa was also shortlisted for the post of Vice Chancellor of Aligarh Muslim University, in which Khatoon later got the post. So they separated themselves from the hearing of the case.

Justice Chandran said, “When I selected Faizan Mustafa, I was the Chancellor of that university… so I can be separated from the case.” However, the Solicitor General requested him that he does not need to separate from the case, and he has strong faith. Meanwhile, CJI Gawai said, “Let my brother decide. Lish the matter before the bench, which does not include Justice Chandran.”

Do not give the role, argue
According to the report of the bar and bench, earlier, senior advocate Kapil Sibal advocated the petition filed against the Allahabad High Court’s decision, saying that if the appointment of the Vice Chancellors continues to be done in this way, then I shivel thinking what will happen in the future. On this, Chief Justice Justice Gawai told Sibal in a bluntly tone, “Instead of giving the role, come directly on the issue and tell us your arguments.”

The case is required to investigate
After this, Sibal argued, “If two votes are cast, they will get only 6 votes. This is only because of the Vice Chancellor’s vote in the Executive Committee and there was another vote. If you remove these two, they will be out.” Sibal further said that he is not demanding a stay, but the investigation of the case is necessary. He said, “There can be no better case based on facts.”

Historic appointment of Naima Khatoon as Vice Chancellor
On the other hand, Additional Solicitor General Aishwarya Bhati said that the appointment of Naima Khatoon as Vice Chancellor is historic. He said, “It is historic. She is the first woman Vice Chancellor of this university. Her appointment is slightly election and slight selection. High court did not agree with Khatoon’s election arguments, despite his appointment upheld.”

Professor Gulrez should not have participated
Chief Justice Gawai commented that Professor Gulrez should not have participated in the process. Justice Gawai said, “Ideally the Vice Chancellor should not have participated in it and the most senior person should have allowed it to join. Now a separate bench of the case will be heard.

What is controversy?
Let us know that in May this year, Allahabad High Court upheld Naima Khatoon’s appointment to the post of AMU Vice Chancellor. The petitioners challenged Khatoon’s appointment on the basis that Khatoon’s husband Professor Mohammad Gulrez was working there as the Vice Chancellor, when his name was recommended. Apart from this, Professor Gulrej also presided over the important meetings of the Executive Council of the University. However, keeping the High Court Nenyukta up, he had ruled that his final selection was made by the visitor, who had no allegations of bias. The President is the visitor of this university. Muzaffar Uruz Rabbani has challenged his appointment.
